Agreement to these Terms

These Terms of Service ("Terms") form a binding agreement between you and Guide Pro ("Guide Pro", "we", "us", or "our") and govern your use of Fishing Guide Pro and related Guide Pro applications and websites (the "Services").

By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Eligibility

You must be at least 16 years old, or the age of majority in your jurisdiction, to use the Services. By using the Services, you represent that you meet this requirement and that you are able to enter into a binding agreement.

Your account

You sign in with Apple to create a single Guide Pro account that works across our apps. You are responsible for maintaining access to your Apple ID and for all activity that occurs under your account. Notify us promptly at support@useguidepro.com if you believe your account has been accessed without authorization.

License to use the Services

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the Services, reverse engineer them, or use them to build a competing product. All rights not expressly granted are reserved by Guide Pro and its licensors.

Your content

You retain ownership of any content you submit to the Services, such as notes or support messages. You grant us a worldwide, royalty-free license to host, store, and use that content as needed to operate and improve the Services. You are responsible for the content you submit and represent that you have the rights to share it.

Guidance is informational only

The Services read conditions and provide guidance, but that guidance is informational only and is not a guarantee. Weather, water levels, tides, and fish are unpredictable, and we do not promise fish or that real conditions will match what the Services show.

You are responsible for your own safety and for the decisions you make on the water. Know the water, watch the conditions, wear appropriate gear, and turn back when conditions are unsafe. You are solely responsible for complying with all applicable laws and regulations, including licenses, seasons, catch limits, and closures. The Services do not replace official regulations, local knowledge, or your own judgment.

Subscriptions and payment

The Services are currently free. If we introduce paid subscriptions, each app is a separate subscription. Purchases made on iOS are processed by Apple under the App Store terms, and any purchases made on the web are processed by our payment provider. Applicable prices, billing intervals, and renewal and cancellation terms will be presented to you before you purchase, and we will update these Terms before charging any fees.

Acceptable use

You agree to use the Services only for lawful purposes. You will not misuse the Services, interfere with their operation or security, attempt to access accounts or data that do not belong to you, or use the Services to violate any law or the rights of others.

Third-party services and other users

The Services may reference or link to third-party services, and may include interactions with other users. We are not responsible for third-party content, products, or conduct, and you release us from claims arising out of your dealings with third parties or other users.

Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT ANY INFORMATION THEY PROVIDE IS ACCURATE, COMPLETE, OR RELIABLE.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GUIDE PRO AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR ANY PERSONAL INJURY OR LOSS ARISING FROM YOUR ACTIVITIES ON THE WATER, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED CANADIAN DOLLARS (CAD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU.

Termination

You may stop using the Services and delete your account at any time from Settings, which permanently removes your account and associated data. We may suspend or terminate your access if you violate these Terms or to protect the Services. Provisions that by their nature should survive termination, including ownership, disclaimers, and limitations of liability, will survive.

Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Before bringing any claim, you agree to first contact us at support@useguidepro.com and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved, you agree that the courts located in Vancouver, British Columbia have exclusive jurisdiction, subject to any mandatory rights you have under local consumer law.

Changes to these Terms

We may update these Terms as the Services change. When we make material changes, we will revise the "Last updated" date above and, where appropriate, notify you within the Services. Your continued use of the Services after an update means you accept the revised Terms.
